ABSTRACT
In the current era of globalization, industrial competition is increasing rapidly
at regional, national and international levels. The strength of the company lies in the
people in the company, namely labor. In Article 1 number 2 of Law Number 13 of
2003 concerning Manpower defines that "Labor is every person who is able to carry
out work in order to produce goods and / or services to meet their own needs and
society." Labor is an important factor in a company, so workers should get their rights
as workers. A right has a legal nature so that right is protected by a legal system. The
issue of employment is always a problem that has never been disputed. Therefore,
workers need to be given protection, maintenance and improvement of welfare as
basic protection to meet the minimum living needs for the workforce.
Scientific writing aims to: First, To find out how the implementation of
workers' rights in the health sector by PT. Sinar Raya Permai based on Law number
24 of 2011 concerning the Social Security Organizing Agency. Second, to find out
how legal liability is against companies that do not register BPJS Health for workers.
Writing this thesis uses the method of sociological legal research that is field
research and to see the effectiveness of law and by leading to descriptive research
there are several types, the writer will use a type of survey, which is a study that takes
samples from one population and uses a questionnaire as a primary data collection
tool to reach conclusions.
From the results of the research problem, the company is obliged to register
BPJS employee health. This was also mentioned in Law Number 24 of 2011
concerning the Social Security Organizing Agency, because the Health BPJS is a
form of social security regulated by the government. This law also regulates company
sanctions for not registering employee health BPJS.
