ABSTRACT
Online buying and selling activity or what is called E-commerce is a
transaction activity that uses electronic media as a means of connecting between
business actors and consumers, so that the agreement or agreement created is
through online. One example of an item that is widely traded online is cosmetics.
Cosmetics distribution is an activity or a series of activities aimed at transferring,
spreading cosmetics. So those who have the right to distribute cosmetics are only
certain people who have a license and are criminalized for those who distribute
illegal cosmetics online without any permission based on Article 197 of Law no.
36 of 2009 concerning Health. Research on law enforcement against perpetrators
of selling illegal cosmetics online by the Pekanbaru Food and Drug Supervisory
Center (BPOM) aims to determine the implementation of law enforcement against
perpetrators of selling illegal cosmetics online as well as obstacles, efforts made
in its implementation.
This type of research can be classified in the type of sociological research,
because in this study the author directly conducts research at the location or
place under study in order to provide a complete and clear picture of the problem
under study. This research was conducted at the Center for Drug and Food
Control (BPOM) Pekanbaru, while the population and sample are all parties
related to the problems studied in this study, the data sources used, primary data,
secondary data, and tertiary data, collection techniques. the data in this study by
observation and interviews.
There were 39 cases of illegal selling of cosmetics sold online in the 2017-
2019 period in Riau Province, BPOM Pekanbaru enforced the law in enforcing
the practice of distributing illegal cosmetic products online in Riau Province, in
coordination with Korwas PPNS / Police, Attorney General's Office, District
Court, Health Office, Satpol PP. The obstacles to the Pekanbaru Food and Drug
Supervisory Center (BPOM) in enforcing criminal law against illegal cosmetic
sellers without online distribution permits are weak public awareness of the
content of cosmetics and the dangers to health, insufficient budget funds and
inadequate human resources (human resources). Efforts made to overcome the
above obstacles are optimizing Law Enforcement, Strengthening and increasing
synergy through collaboration with stakeholders or other criminal justice systems,
Collaborating with IdEA (Indonesian E-Comerce Association), Collaborating
with cargo transportation services, Collaborating with the Ministry of
Communication and Information and Outreach and outreach to the community.
