ABSTRACT
One of the problems faced by the Indonesian people today is overloading or
insufficient space in the Penitentiary Institution (LAPAS) because of penalties
which always end up in prison and enter LAPAS. Even some cases of petty crimes
sometimes even lead to prison. Prisoners who have been freed from detainees who
have no ability or expertise whatsoever other than committing crimes, when free
they will still repeat the crime they have committed (recidivist) and return to
detention or detention centers. The detention center's condition should have
reduced prisoners but as a result of recidivists re-entering again. Overloading of
the space provided in correctional institutions in Indonesia has occurred a lot.
Hopefully, imprisonment can be transferred to other types of punishment that will
give more changes to the conditions of prisons in Indonesia.
This type of research is a normative legal research that is using literature
study in finding data. This research is descriptive in nature which tries to provide
detailed and detailed data on the existing problems. In writing this research uses
qualitative data analysis which means to explain and conclude about the data that
has been collected by the author. This study uses secondary data or scientific data
that has been codified.
The results of this study are to explain that social work crime can be
applied or tried to be formulated also in Indonesia. Like some countries such as
the Netherlands, Germany and Italy which have known social work criminal for a
long time but it is said to be a punishment of social work. Even though Article 10
of the Indonesian state criminal law has not yet been regulated in terms of
criminal punishment for social work, but in the Indonesian RKUHP it has been
alluded to applying this social work crime as a type of punishment that can be
applied to criminal offenders who spend their time in Penitentiary (Lapas).
Learning prisoners' skills or additional skills outside prison needs to be done so
that prison space or capacity can be more adequate and when the prisoner is
released, he has work skills that can be done so that he will not repeat the same
crime he once did.
