Perlindungan Hukum Terhadap Konsumen Pengguna Parfum Isi Ulang Yang Tidak Mencantumkan Label Komposisi Di Kota Pekanbaru
ABSTRACT
Consumer protection guaranteed by the UUPK is the existence of legal
certainty for all consumer needs. Legal certainty includes all efforts based on law
to empower consumers to obtain or determine their choice of goods and / or
services needed and to defend or defend their rights if they are harmed by
business actors as providers of consumer needs. These perfume products that are
bought by people with the aim of getting perfect and satisfying results are actually
detrimental to their own health. One example of a product without clear label or
composition contained in it is refill perfume which is often referred to as refill
perfume which is on the rise in the city of Pekanbaru. The problems that the
authors make the basis for in this study are how legal protection for consumers
related to the use of refill perfumes that do not include composition labels in the
city of Pekanbaru and how are business actors responsible for refill perfume
products that do not include composition labels in the city of Pekanbaru
This type of research used by the author is sociological legal research,
which is also called doctrinal legal research. This normative research is a study
that discusses the principles of law, legal systematics, the level of legal
synchronization, legal history and legal comparisons. From this sociological legal
research, the author is interested in conducting research using legal systematic
criteria.
The results of this research are, first, the protection of consumers related
to the sale of cosmetic products without the composition of the ingredients
regulated in the UUPK contained in Article 4 letter c. The right to information is
important for consumers, because with information consumers can choose the
desired product and avoid losses due to product misuse. Providing information is
also an obligation of business actors as regulated in Article 7 letter b. In addition
to protection through rights and obligations, consumer protection can also be
protected by actions that are prohibited by business actors as regulated in Article 8
letter iUUPK. Second, responsibility is the obligation of business actors if
consumers feel disadvantaged. Regarding the responsibilities of business actors
regulated in Article 19 UUPK. Business actors can be responsible by providing
compensation in the form of refunds or replacement of goods.
