ABSTRACT
The crime of rape occurs in many women and girls who are very
vulnerable to violence perpetrated by people around them, in public areas,
workplaces, even in their own homes. One of the most detrimental effects of a
rape victim is a pregnancy that the victim does not want. This can be seen in the
Criminal Code (KUHP) CHAPTER XIV which regulates the criminal act of rape
(article 285), article 285, the rule that goods with violence or threats of forced
labor of women have sex with him outside of marriage, is threatened by someone
because committed rape, with a maximum imprisonment of twelve years.
Therefore, it needs to be studied in a stimulant manner. First, how is the
protection of children resulting from the crime of rape in the perspective of
victimology, Second, what is the ideal concept of child victims of rape in the
perspective of victimology.
This research is a normative legal research, because it is based on
literature research which takes quotations from reading books, literature, or
supporting books that have problems to be studied assisted by primary, secondary
and tertiary data sources. This study uses qualitative data analysis and produces
descriptive data.
From the research, it is revealed that, First, the absence of statutory
regulations which are used as a legal basis for victim protection also has an
impact on not paying attention to the protection of crime victims at the stage of
implementing and implementing sanctions, second, the threat of punishment
against the perpetrator of rape, the Criminal Code about the act of rape is a
maximum of 15 years, in fact many of the crimes of rape have not reached the
maximum decision. While the victim must live in the face of losses, it is very unfair
that it should be. The author's suggestion is, First, the victim and the child of the
victim who are given more protection, this is because many victims have suffered
physical, mental, psychological and economic losses to continue their life with
their children as a result of the rape, second, the government guarantees the
welfare of children from From the criminal act of rape, there is currently no
special treatment for children from the crime of rape.
