Putusan Pengadilan Hubungan Industrial Di Pengadilan Negeri Pekanbaru Terhadap Pemenuhan Hak Pekerja Pada Sengketa Pemutusan Hubungan Kerja

ABSTRACT
Workers or laborers can be said to be workers if there is a work
relationship and work agreement. In work relations there are frequent work
disputes, one of which is layoffs. Layoffs can be carried out by workers, one
example in the PT. RICRY Case with 366 workers. Termination of layoffs is
carried out at the Industrial Relations Court. The verdict of the industrial
relations court judge at the Pekanbaru District Court number: 103 / Pdt.sus-PHI /
2018 / PN.Pbr did not grant the lawsuit regarding processing wages. The purpose
of writing this thesis, namely; First, to find out the verdict of the industrial
relations court judge at the Pekanbaru District Court number: 103 / Pdt.sus-PHI /
2018 / PN.Pbr is in accordance with the theory of justice; Second, to find out the
decision of the industrial relations court at the Pekanbaru District Court number:
103 / Pdt.sus-PHI / 2018 / PN.Pbr has provided legal certainty.
This type of research is classified in the type of normative law research.
The research was conducted at the Pekanbaru District Court. The data source
used is secondary data and is supported by primary data using interview
techniques. The data collection technique used was from the study of documents
or library materials. Then the data were analyzed qualitatively and obtained from
secondary data.
Based on the results of the research on the problem, there are 2 main
things that can be concluded, namely first, the decision of the industrial relations
court at the Pekanbaru District Court Number: 103 / Pdt.sus-PHI / 2018 / PN.
The judge decided not to grant the plaintiff's claim regarding the process fee.
heed Rawls's principle of justice, because the panel of judges did not consider the
provisions regarding process wages which were clearly regulated in Article 152
of Law Number 13 Year 2003 concerning Manpower and Decree of the Minister
of Manpower Number Kep.150 / Men / 2000 Year. Second, the panel of judges in
deciding cases in the decision of the industrial relations court at the Pekanbaru
District Court Number: 103 / Pdt.sus-PHI / 2018 / PN.Pbr did not provide legal
certainty to workers / laborers because they did not pay attention to the facts
during the trial and did not appropriate in applying the legal basis which is
clearly stipulated in Article 152 of Law Number 13 of 2003 concerning Manpower
and the Decree of the Minister of Manpower Number Kep.150 / Men / 2000 of the
year. The author's suggestion is that the judges in deciding cases should also be
guided by Article 152 of Law Number 13 of 2003 concerning Manpower and the
Decree of the Minister of Manpower Number Kep.150 / Men / 2000 of 2000 so
that the basis of justice according to Rawls is fairness or pure procedural justice
(justice as equality) can provide court decisions that are in accordance with
justice and impartiality and guarantee the interests of all people and can also
provide legal certainty to workers / laborers by paying attention to the facts
during the trial and the legal basis that is clearly regulated.
