In the history of its handling, almost no institution or institution has escaped law enforcement on corruption. On the one hand, this is good news because it means that corruption law enforcement in Indonesia is not selective. Anyone who commits a criminal act of corruption will be prosecuted and legally processed. Laws and regulations that specifically regulate corruption have been amended 4 (four) times, namely Government Regulation in Lieu of Law Number 24 of 1960 concerning Investigation, Prosecution and Examination of Corruption Crimes, Law Number 3 of 1971 concerning Eradication Corruption Crime, Law Number 31 Year 1999 concerning Eradication of Corruption Crime, and Law Number 20 Year 2001 concerning Amendments to Law Number 31 Year 1999 concerning Eradication of Corruption Crimes.
This research is normative-empirical legal research (applied law research), which uses normative-empirical legal case studies in the form of legal behavior products. The main point of the study of normative-empirical legal research is the implementation or implementation of positive legal provisions and contracts in fact at any particular legal event that occurs in society in order to achieve predetermined goals.
From the results of the research that the authors conducted, it can be concluded, firstly, the return of state losses incurred by the perpetrators of corruption during the prosecution process at the Pekanbaru Corruption Court, was carried out by entering the money into the temporary holding account of the Kampar District Prosecutor's Office which has been verified by the Ministry. RI Finance. Second, the return of state losses during the prosecution process is not an excuse or justification for abolishing crimes, the legal process continues because the criminal act has occurred (voltoid). In accordance with the provisions in Article 4 of the Corruption Eradication Law, the Public Prosecutor at the Kampar District Prosecutor's Office continues to charge the defendants with imprisonment to be accountable for their actions.
