This study aims to analyze Judges' considerations in implementing
criminal sanctions against perpetrators of criminal acts of theft during the Covid-
19 pandemic based on SEMA No. 1 of 2020 concerning Guidelines for
Implementing Tasks During the Prevention Period for the Spread of Corona Virus
Disease 2019 (Covid - 19) in the Indonesian Supreme Court and the Judiciary
Bodies under it, so that with the application of criminal sanctions based on SEMA
No. 1 of 2020 provides a conditional criminal sentence with a probationary
period considered to reduce the number of prisoners living in the correctional
institution. This study uses sociological legal research methods, namely direct
research to the research location using data collection tools in the form of
interviews.
The results showed that there were judges' subjective considerations in
imposing criminal penalties at the beginning of the Covid 19 pandemic, but it was
not too significant. This can be seen from the verdict before and during covid,
where the difference in the length of imprisonment is shorter during the covid
pandemic than before the covid. That is also confirmed through interviews with
judges who state that judges explore the legal values that exist in the community /
environment so that the social facts which exist in the community at this time there
is a Covid 19 pandemic that needs prevention and overcoming by providing legal
considerations criminal acts committed by the defendants during this pandemic,
namely giving a conditional criminal verdict on the criminal act of theft
committed by the defendant, thus the defendants would be reduced in prison
terms, and this would certainly reduce the capacity of prison inmates, and the
prevention of Covid 19 can be implemented properly by the Pekanbaru District
Court and its staff.
