Penegakan Hukum Terhadap Pelaku Pelanggaran Administrasi Oleh Syahbandar Dalam Tindak Pidana Pelayaran Di Provinsi Riau

With the many violations both administratively and in criminal cases in the territorial waters of Riau Province, more specifically in Indragiri Hilir, Indragiri Hulu and Dumai. For this reason, there must be law enforcement efforts made by the Harbormaster for both administrative and criminal offenses. The formulation of the problem is how law enforcement against perpetrators of administrative violations by the harbormaster in shipping crimes in Riau Province, what are the inhibiting factors in law enforcement by the harbormaster in carrying out his duties in Riau Province. This type of research is an empirical / sociological legal research. With a quantitative approach to ship owners, kasi and employees of the Harbormaster Indragiri Hilir, Indragiri Hulu, and Dumai as population and sample. Data collection techniques using purposive sampling technique and data collection methods through interviews, questionnaires, literature study. The results of the research show that law enforcement by Syahbandar Indragiri Hilir is bad, because there have been many administrative violations and criminal acts that have not been followed up due to bribery. Meanwhile, law enforcement at Sayahbandar Indragiri Hulu was also bad because the members of the Shahbandar in carrying out their duties were due to intervention by government officials, so that the tasks carried out were only formality. Unlike the case with Syahbandar Dumai, law enforcement is good because in carrying out their duties, members are supported by their superiors and even superiors are involved in overseeing the performance of their members. The inhibiting factor in law enforcement by the downstream Indragiri harbormaster is the lack of facilities and infrastructure in carrying out patrol duties such as inadequate Speed Boat. Meanwhile, the inhibiting factor of the Indragiri Hulu Harbormaster lies in the intervention of government officials who make them unable to carry out their duties optimally. Meanwhile, Syahbandar Dumai only experienced problems due to natural conditions such as waves, heavy rain and others.
