The topic of the problem in this writing is about how the responsibility of the consular doctor for the actions of his resident doctor if his medical action fails, one of which happened in Indonesia is the case of a doctor named Dewa Ayu Sasiary Prawani or who is often called Doctor Ayu. The incident that occurred during the medical treatment performed by doctor Ayu was an emergency even though doctor Ayu was currently a resident. However, in Permenkes 2052 of 2011 that the requirement to perform surgery is to have a Practice License. How can a resident doctor have a license to practice while he is still studying medicine education. On this basis, the authors formulate the formulation of the problem: What is the criminal responsibility of the consular doctor for the medical action of a resident doctor who does not have a license to practice? How is legal protection for resident doctors in practicing medicine related to the theory of criminal responsibility? What is the ideal concept of legal protection for resident doctors in practicing in Indonesia? The research method used is normative legal research or qualitative analysis literature law research, namely by explaining the existing data in words or statements, the author conducts research with the aim of drawing legal principles ("rechsbeginselen") which can be carried out against positive law. . The conclusion from the results of this study is that from the past until now there has been no rule in the legislation governing the accountability of the consular doctor for his resident doctor's actions. Likewise, legal protection for resident doctors in practicing medicine, which is a medical study curriculum, has not yet been regulated in detail in the medical law. The ideal concept of legal protection for resident doctors in carrying out medical practice in Indonesia is that every resident doctor who practices at a teaching hospital or network hospital, the doctor in charge, namely the consulent doctor must accompany him so that any medical practice performed by the resident doctor can known to facilitate problem solving in determining the action.
