Pelaksanaan Urusan Pemerintah Konkuren Dalam Penyelesaian Sengketa Tanah Ulayat Di Kabupaten Kuantan Singingi
Article 2 of Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles that the affairs of the land are government affairs organized by the Government, therefore also the resolution of land disputes is the authority of the Government. This is confirmed again in Presidential Regulation No. 63 of 2013 concerning the National Land Agency, which explicitly states that the National Land Agency (BPN) as a non-departmental government agency has the task of carrying out governmental tasks in the national, regional and sectoral land affairs.
This study aims to determine the synergy of traditional leaders with local governments in the resolution of conflicts over customary land disputes in Kuantan Singingi Regency. This research is a type of juridical sociological research, namely empirical studies to find theories about the process of occurrence and about the process of working of law in society. The research method is processed and analyzed qualitatively by analyzing data based on quality and then described using words so that discussion or exposure is obtained in the form of sentences that are systematic and understandable, then drawn conclusions.
From the results of the research that the author did, it can be concluded that, firstly, the implementation of concurrent government affairs in Kuantan Singingi Regency in the settlement of customary land disputes is a matter of regional government based on law number 23 of 2014 concerning regional government. In the implementation of regional government, regional government is based on the principles of decentralization, the principle of autonomy and principle of implementation with the principles of regional governance based on the principle of legal certainty, principles of orderliness, transparency, principles of proportionality, principles of professionalism, principles of accountability, principles of efficiency and effectiveness. Second, in the Settlement of customary land disputes the Kuantan Singingi Regency Government has indeed contributed to various tabaha ulayat disputes through the Forestry Service by facilitating meetings of the disputed indigenous peoples and acting as a mediator in the settlement of these disputes.
