ABSTRACT
According to Minangkabau custom, a person or community inherits an
heirloom from their grandmother or from their mother, according to custom
they can only control or use the heirloom, but may not sell or gift property to
anyone. But in reality there are cases regarding the control of land of high
inheritance by nephews of the Pitopang Tribe, the control is carried out through
a buying and selling transaction process. The purpose of writing: first, to find
out the legal strength of the control of land of high inheritance by a nephew of
the Pitopang Tribe, second, to find out the efforts that can be taken in resolving
land ownership disputes by nephews of the Pitopang Tribe.
This type of research can be classified into the type of sociological
research. This research was conducted in Koto Panjang Dalam Subdistrict,
Lamposi Tigo Nagari District, Payakumbuh City, while the population and
sample were parties related to the problems examined in this study. Retrieval of
data by interview and library study methods,
From the research, there are two main points that can be concluded. First,
the legal power of land ownership of high heirlooms by nephews in the
Pitopang Tribe of Koto Panjang Dalam Subdistrict, Lamposi Tigo Nagari
District is not valid, where high heirloom land cannot be traded, if it is traded it
can eliminate the beneficial value of the high satisfaction property. Second, the
efforts taken in resolving land tenure disputes by nephews of the Pitopang Tribe
are consensus, mediation by appointing Ninik Mamak as the mediator, and
issuing a certificate by Ninik Mamak, but until now the problem of land
disputes is This has not been completed. The author's advice, first, to obtain
legal power in controlling the land of this high heritage, the author gives
suggestions so that the sale and purchase made between D Dt. Indo Marajo with
Sahar D. was canceled by Ninik Mamak, and issued a statement stating that the
land of high inheritance was part of Sahar D. as the nephew of D Dt. Indo
Marajo. Second, to resolve customary disputes related to high inheritance,
Ninik Mamak as a customary leader must play an active role in every case
related to inheritance, in order to prevent prolonged disputes between
indigenous peoples.
