Penegakan Hukum Terhadap Pelaku Kekerasan Fisik Asisten Rumah Tangga (Studi Kasus Wilayah Kepolisian Daerah Riau)
ABSTRACT
Domestic violence according to Law Number 23 of 2004 concerning the
Elimination of Domestic Violence is any act against someone, especially women,
which results in physical, sexual, psychological, and domestic neglect including
threats to commit acts of coercion, or illegal deprivation of liberty within the
scope of household including household assistants based on Article 2 of Law
Number 23 Year 2004 concerning the Elimination of Domestic Violence. In the
Riau Regional Police, a criminal case of physical violence committed by an
employer against his household member ended with a peace that was agreed by
both parties. However, according to Indonesia's current positive law, domestic
violence cannot be resolved peacefully, because domestic violence is not a light
crime and is a pure offense.
The purpose of this research is to find out law enforcement against
perpetrators of physical violence domestic assistants, barriers to law enforcement
against perpetrators of physical violence as household assistants based on Law
Number 23 of 2004 concerning the Elimination of Domestic Violence in the Legal
Territory of Riau Province. This research was conducted at PPA Polda Riau,
while the population and sample were all parties related to the problems studied
in this study, the data sources used, primary data, secondary data, and tertiary
data, data collection techniques in this study were carried out by interviews, and
literature study.
From the results of research and discussion, the following conclusions
are obtained: First, the absence of fair law enforcement against perpetrators of
physical violence as household assistants. Cases classified as Ordinary Delik end
with the dismissal of the case (Henti Lidik) by the police with a peace agreed
upon by the families of the victims and the suspect. Second, barriers to law
enforcement are the cost factor, minimal legal insight into the victim and family,
evidence that is deemed insufficient, and the implementation of alternative dispute
resolution by the police on the case. From the results of this study, the authors
suggest that the Police can be more assertive in carrying out the existing laws and
regulations in accordance with the cases that occur.
