ABSTRACT
The criminal act of illegal fishing that occurs in Indonesian territorial
waters is a threat that can disrupt the stability of the country's security and
economy. Actually, there are quite a lot of regulations and legal products related
to the management and utilization of natural resources properly, but in solving
the criminal act of illegal fishing through positive law it is deemed ineffective,
especially for people in Mandah District. This is due to the fact that Mandah
District is a remote area that is far from access to formal justice, the high costs of
transportation in this area using sea transportation, and a lack of public
understanding of formal justice.
In this research, the formulation of the problem is, first, how is the process
of solving criminal acts of illegal fishing according to Malay customary law in
Mandah District, Indragiri Hilir Regency, second, what is the legal consequences
for the settlement of illegal fishing crimes according to Malay customary law in
Mandah District, Indragiri Hilir Regency. . This research is included in the type
of sociological research, namely empirical studies to find theories related to the
process of law work in society and the form of law that applies in society. This
research was conducted in Mandah District, Indragiri Hilir Regency. Sources of
data used are primary data and secondary data. Data collection techniques in this
study were conducted by interview and literature review.
The results of this study are first to know the process of solving criminal
acts of illegal fishing according to Malay customary law in Mandah Subdistrict,
Indragiri Hilir Regency, second knowing the legal consequences of solving
criminal acts of illegal fishing according to Malay customary law in Mandah
District, Indragiri Hilir Regency. The purpose of this study is also the author's
idea of the Indonesian law in order to revive the value of local wisdom related to
the settlement of illegal fishing crimes.
