Perlindungan Hukum Terhadap Anak Sebagai Korban Tindak Pidana Cyberbullying Berdasarkan Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik
ABSTRACT
Cyberbullying is a bullying done with cyber media or social media that can
be violence, bullying, threats, or coercion to harass or intimidate others.
Cyberbullying is aggressive and purposeful behavior that a group or individual
engages in, using electronic media, over and over again from time to time,
against someone who is considered not easy to resist such actions. This study
aims to find out the legal protection of children who are victims of cyberbullying
crimes based on law No. 19 of 2016 on Amendments to Law No. 11 of 2008 on
Information and Electronic Transactions and to know the obstacles in legal
protection of children who are victims of cyberbullying crimes.
This type of research is classified into normative legal research methods
because the purpose of this study is to see the level of legal synchronization of
victims of cyberbullying crimes based on the Criminal Code with law No. 19 on
amendments to Law No. 11 of 2008 on Information and Electronic Transactions,
as well as legislation related to the data sources used, namely primary data,
secondary data and tertiary data by conducting data collection techniques of
literature studies.
The results of this study there are three main things that can be concluded
First, legal protection of children who are victims of cyberbullying crimes can not
be applied optimally because of the difficulty of recognition from victims. Second,
there are obstacles in the form of weak legal protection for children who are
victims of cyberbullying based on article 27 paragraph (3) of the Electronic
Transaction Information Law that refers to the Criminal Code and other relevant
laws and regulations. Third, there are obstacles in the form of not optimal
cooperation of the government, family and society to provide legal protection to
children who are victims of cyberbullying.
