Analisis Yuridis Keabsahan Persidangan Peradilan Pidana Secara Online Yang Dilakukan Di Tengah Pandemi Coronavirus Disease-19

In the midst of the Coronavirus Disease 2019 (Covid-19) outbreak, it has had a
huge impact on the Indonesian people themselves, both in the economic, social,
cultural, tourism fields and in the field of law enforcement itself. In the Criminal
Procedure Code (KUHAP) the trial process is carried out directly which adheres
to the principle of open court justice. However, with the conditions of the Covid-
19 outbreak, the trial was held online using a teleconference facility as a
cooperation agreement between the Attorney General represented by the Deputy
Attorney General for General Crimes and the Supreme Court represented by the
Director General of General Justice and the Ministry of Law and Human Rights
represented by the Acting Director General of Corrections. The formulation of the
problem is how is the validity of criminal justice trials conducted online in the
midst of the Covid-19 pandemic, how is the concept of criminal justice trials
conducted online in the future. The research method uses normative legal
research. The results of the study concluded that the validity of online criminal
justice trials in the midst of the Covid-19 pandemic is legal in the criminal justice
system, this is based on Perma Number 4 of 2020 Administration and Trial of
Criminal Cases in Courts Electronically and the cooperation agreement between
the Attorney General represented by Deputy Attorney General for General Crimes
with the Supreme Court represented by the Director General of General Justice
and the Ministry of Law and Human Rights represented by the Acting Director
General of Corrections. The concept of criminal justice trials conducted online
for the future must pay attention to what are the current juridical obstacles in
carrying out the online criminal justice trial process. For this reason, it is
necessary to regulate in the Criminal Procedure Code regarding online trials so
that the legal basis becomes clearer and stronger. Apart from that, it is necessary
to prepare adequate electronic equipment and devices by regional work units,
both at the District Court, District Attorney and at the Correctional Institution.
