ABSTRACT
The need for road transportation is increasing over time, causing
transportation problems to become increasingly complex, these transportation
problems include, among others, permit for transportation routes and regulations
for this type of transportation, which are not balanced with the provision of
adequate public transportation, especially in terms of transport capacity, not even
a few of them. public transportation companies make these vehicles as service
transportation and delivery of goods.
This study uses a sociological juridical research method. This research
was conducted in Pekanbaru City by taking data through interviews with PT Ayah
Ibu Transport and also the users of these transportation services. The collected
data were analyzed qualitatively and deductive conclusions were drawn, namely
drawing conclusions from general to specific.
The results of this study indicate that: First, the philosophical, sociological
and juridical basis for the differentiation of the transportation arrangements for
people (passengers) and the transportation of goods, namely: Philosophical
basis: Philosophically, people or humans with goods are certainly different in
position, essence and dignity. Humans are different from things that are
inanimate objects and do not require special guarantees of safety, especially
regarding life. Sociological basis: related to the safety and comfort of public
transport service users. If you are forced to transport goods by transporting
people, the potential for accidents will be greater. Juridical basis: Article 137
paragraph (4) of the LLAJ Law. Second, the factors that cause people to use
passenger transportation services to send entrusted goods are due to 3 (three)
things, namely practicality, lower costs and faster delivery of goods. Third, the
responsibility of PT. Father and Mother Transport for the transportation of goods
using person transportation which causes losses to consumers is done with the
concept of compensation. Because a civil agreement has been born between the
bus driver and the owner of the goods. Actions against the law of a bus driver that
cause loss to the owner of the goods must be accounted for with compensation by
PT Ayah Ibu Transport based on the provisions of Article 1365 of the Civil Code,
Article 193 of Law no. 22 of 2009 concerning Traffic and Public Transportation
and Article 19 of Law Number 8 of 1998 concerning Consumer Protection.
