Penegakan Hukum Terhadap Penambangan Emas Ilegal Di Wilayah Hukum Kepolisian Resor Sawahlunto
ABSTRACT
Mining activities carried out in Rantih Village, Talawi District,
Sawahlunto Regency are mostly carried out by extracting gold mines without
having a permit. Gold mining activities without a permit may be subject to
criminal sanctions in Article 158 of Law Number 3 of 2020 concerning
Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining.
Even though there are rules that regulate illegal gold mining activities in
Sawahlunto Regency during raids, it is very rare for the gold mining perpetrators
to be caught. All of this is due to the presence of individuals who collaborate with
groups or limited companies that carry out illegal gold mining activities. The
purpose of this research is to find out how to enforce the law and what obstacles
and efforts are being made to enforce the law against illegal gold mining in the
jurisdiction of the Sawahlunto Resort Police.
This type of research is classified as sociological legal research, using
juridical-empirical research methods which are carried out by combining legal
materials (which are secondary data) with primary data obtained in the field. This
research was conducted at the Sawahlunto Resort Police, while the population
and sample were parties related to the problem being studied such as the
Criminal Investigation Unit, Investigators, and Actors at the Sawahlunto Resort
Police, the data source used was primary data obtained directly from existing
data at the Resort Police. Sawahlunto, and secondary data consisting of primary
legal materials, secondary legal materials and tertiary legal materials, while the
data collection techniques in this study were conducted by interviews, and
literature study.
The result of the research is that law enforcement against illegal gold
mining at the Sawahlunto Resort Police has been running according to the
applicable rules, even though in reality it has not run optimally. The inhibiting
factors are the conflict from the community and workers, the lack of legal
awareness of the community, the lack of socialization from the local government,
the lack of the role of the community in helping law enforcement officers, and the
presence of police officers involved. Efforts that can be made by the government,
police and other related parties work together to disseminate information about
illegal gold mining, the police maximize supervision and raids, the local
government facilitates mining permits, creating more jobs. The advice that can be
given is that the Government, the Police, the Mining Service and other related
parties and the community can cooperate well in seeking law enforcement against
illegal gold mining in Sawahlunto City.
