Pelaksanaan Perjanjian Kerjasama Budidaya Ayam Pedaging Antara Peternak Dengan Pt. Indojaya Agrinusa
ABSTRACT
The The plasma core partnership agreement for broiler farms between the
farmer and PT. Indojaya Agrinusa is an agreement legally made to act as law for
the parties who make it, in accordance with the principle of "pacta sunt servanda"
in contract law. In its development, the principle of pacta sunt servanda is based
on the principle of good faith. Thus the plasma core partnership as outlined in the
cooperation agreement between the farmer and PT. Indojaya Agrinusa must also
be implemented in good faith as regulated in Article 1338 Paragraph (3) of the
Civil Code which states that: “An agreement must be executed in good faith”. The
purpose of writing this thesis, namely: First, to determine whether the
implementation of the plasma core partnership agreement for broiler farms
between the farmer and PT. Indojaya Agrinusa in Pekanbaru City has been
implemented in accordance with the principle of good faith. Second, to find out
the legal consequences if the implementation of the core partnership agreement
for broiler farms between farmers and PT. Indojaya Agrinusa is not based on the
principle of good faith in Pekanbaru City.
This type of research can be classified as empirical juridical research,
another term used is sociological because in this study the author directly
conducts research at the location or place under study in order to provide a
complete and clear picture of the problem being studied. The study was conducted
at the location of a broiler farm. The nature of this research is descriptive with
primary data sources, secondary data and tertiary data, while the population and
sample are the parties to the cooperation agreement studied in this study. Data
collection techniques are interviews and literature study.
From the results of the research problem there are two main things that
can be concluded. First, the implementation of a broiler farm partnership
agreement between farmers and PT. Indojaya Agrinusa does not comply with the
principle of good faith. Because the breeder has violated the contents of the
agreement about something that is forbidden to do without the consent of the
other party in the agreement. The farmer in this case has violated Article 7
Paragraph (2) and Article 7 Paragraph (3) of the cooperation agreement and
Article 1338 Paragraph (3) of the Civil Code. Second, the legal consequences that
can arise as a result of not carrying out the agreement in good faith according to
the agreement are that the breeder must carry out the agreement in good faith,
bear all losses arising from not carrying out the agreement in good faith, and
unilaterally terminating the agreement.
