ABSTRACT
Indonesia is an agrarian country, the importance of the meaning of land
for human life is because every human being needs land because there are no
activities or activities of people who do not need land. With the rapid population
growth, land is scarce and limited in achieving people's prosperity which is
divided fairly and evenly. With the existence of monopoly land control, it is
necessary to study the cause of private ownership of agricultural land that exceeds
the ownership limit and how efforts are made to overcome private ownership of
agricultural land that exceeds the ownership limit in Tebing Tinggi Timur District,
Meranti Islands Regency. In this regard, the provision, designation, control, use
and maintenance need to be regulated in order to ensure legal certainty in the
control and utilization as well as to provide legal protection for the people at
large, especially the farmer group, while maintaining the sustainability of their
ability to support sustainable development activities.
This type of research is sociological juridical, this research is descriptive
analytic. The location of this research is in Tebing Tinggi Timur District, Meranti
Islands Regency. Sources of data used, primary data, secondary data and tertiary
data. Data collection techniques with interviews and literature reviews.The results
showed that the factors causing monopoly land ownership were cultural factors,
weak government control, lack of legal awareness, substance factors, economic
values, as for efforts to overcome them by involving the role of customary
institutions and land offices, socialization and counseling about land. . In addition,
the provisions on the prohibition of massive land ownership that currently exist
still need to be reviewed to be adjusted to the current development and needs of
the community. there needs to be a role for local customary institutions to
socialize to the public the regulations related to the prohibition of land ownership
that exceeds the ownership limit and the prohibition of the practice of buying and
selling land under the hands. the provision of sanctions for violations of the
prohibition of ownership of private rights over agricultural land that exceeds the
ownership limit is updated and adapted to the current development progress, and
its implementation is to be more emphasized.
