The Prosecutor's Office often encounters cases involving women and
children. For this reason, the Prosecutor's Office is an important actor in efforts
to provide protection to female and child witnesses or victims. Prosecutor's Guide
Number 1 of 2021 concerning Access to Justice for Women and Children in
Handling Criminal Cases has the purpose of being a reference for prosecutors in
fulfilling access to justice for women and children who are in conflict with the law
in handling criminal cases. This thesis discusses the juridical review of the
prosecutor's authority in accessing justice for women and children in handling
criminal cases.
This type of research can be classified as normative legal research by
using the criteria of legal principles. Sources of data used, namely: primary legal
materials, secondary legal materials and tertiary legal materials. The data
collection technique is literature study. Data analysis was carried out
qualitatively, namely the data obtained not using statistics or mathematics or the
like.
Access to justice is provided through formal and non-formal channels.
Through formal channels, providing access requires regulations that fully
prioritize the interests of women and children, in addition to the existence of
relevant institutions that have high capacity and are able to carry out their duties
and functions professionally. The scope of the Prosecutor's Guide Number 1 of
2021 concerning Access to Justice for Women and Children in Handling Criminal
Cases is the handling of criminal cases involving women and children who are in
conflict with the law at the stage of investigation, investigation, pre-prosecution,
prosecution, examination in court and the implementation of court decisions that
has obtained permanent legal force. The constitution states that every citizen has
the same position before the law, and is treated equally without discrimination on
any basis. The state accommodates the rights of everyone, including the rights of
women and children in conflict with the law as an effort to provide protection and
access to justice in the justice system. The prosecutor's office as a law
enforcement officer should implement the laws and regulations that have been
made and agreed upon, so as to ensure gender equality, equal protection and
non-discrimination.
