This study examines legal protection for creditors in e-aggregator-based
lending services, focusing on the principles of prudence. The rapid development
of financial technology (fintech) in Indonesia, especially e-aggregator platforms,
brings both benefits and challenges, including the risk of default. Using normative
legal research methods, this study analyzes the regulatory framework based on
OJK Regulation No. 77/POJK.01/2016 and its implications for creditor
protection. The research findings emphasize the importance of implementing the
"Know Your Customer" (KYC) principle to assess the creditworthiness of
borrowers and the need for tighter supervision by the Financial Services
Authority (OJK). Ensuring transparency and fairness in transactions.
Recommendations proposed include regulatory reform to improve creditor
protection, the use of advanced technology for real-time transaction monitoring,
and increasing public education on the rights and obligations of fintech users.
This research contributes to creating a safer and more transparent fintech
ecosystem in Indonesia.
