ABSTRACT
In perfect and simplify human relationships in meeting daily needs, agreements (kad) are carried out in the form of sales and purchases, leases, debts and receivables, and so on. Such is the case with the implementation of the durian plantation land sale and purchase agreement in Lalang Village, Sungai Apit District, Siak Regency. In this case, there was a breach of contract between the parties. Therefore, the objectives of this thesis research are: First, how is the implementation of the Durian Plantation Land Sale and Purchase Agreement in Lalang Village, Sungai Apit District, Siak Regency? Second, how are the parties' efforts to resolve the Durian Plantation Land sale and purchase in Lalang Village, Sungai Apit District, Siak Regency?
This type of research can be classified as sociological juridical research, with the research location located in Lalang Village, Sungai Apit District, Siak Regency. This research uses data sources in the form of primary data and secondary data, and the data collection techniques used are interviews and literature review.
From the results of this case research, there are two main things that can be concluded. First, the implementation of the sale and purchase agreement for durian plantation land in Lalang village, Sungai Apit District, Siak Regency is not in accordance with the provisions of the Civil Code and does not implement the principles of pacta sunt servanda and freedom of contract in the agreement. Second, efforts to resolve the parties in the sale and purchase of durian plantation land resulted in denial of the rights and obligations of the parties. The author's advice is firstly, it is best for the parties who have made an agreement to try to fulfill the articles of the contents of the agreement that have been made previously, because an agreement that has been legally made cannot be canceled unilaterally by just one party. Second, when drafting an agreement, it's best to first read and discuss the articles or content of the agreement and then reach an agreement. This will prevent coercion or being forced into a standard contract. Article 1338 of the Civil Code stipulates that all legally entered into agreements are legally binding for those who make them.
