Land has an important role in human life, covering economic, social, cultural, political and ecological aspects. Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA) regulates the use of land in Indonesia for the public interest by taking into account its social function. However, conflicts related to land ownership and use often occur, including plantation land disputes.This research discusses the implementation of the cooperation agreement between PT Peputra Supra Jaya and the Gondai Bersatu Cooperative in Langgam District, Pelalawan Regency, Riau Province, as well as the impact of the Indonesian Supreme Court Decision Number 1087 K/Pid.Sus.LH/2018 on this agreement. Both parties must ensure that the implementation of cooperation continues to comply with applicable legal regulations and avoid violations that could cause additional legal consequences.
The type of research used by researchers is sociological legal research. Sociological research is research on law observing what characterizes the behavior of people in a region in an aspect of social life. The research location is in the Gondai Bersatu Cooperative, Langgam District, Pelalawan Regency, while the population and sample are all parties related to the problem under study. This research uses data sources in the form of primary data and secondary data, and data collection techniques are carried out by interviews.
There are two things that can be concluded from the results of this research. First, the Supreme Court decision requires PT Peputra Supra Jaya to return part of the land to the state, which has an impact on the implementation of the cooperation agreement with the Gondai Bersatu Cooperative. This research found that the decision affected regulatory compliance, legal stability, and business practices in the plantation industry.Both impacts on the Gondai Bersatu Cooperative include legal and financial consequences.Through analysis of agreements and legal impacts, this research seeks to provide guidance for plantation business actors in complying with regulations and managing legal conflicts, as well as offering solutions to increase fair and sustainable cooperation between companies and cooperatives.
