Proses Pelaksanaan Eksekusi Putusanpengadilan Dalam Perkara Tindak Pidana Ringan Di Kejaksaan Negeri Pelalawan
Cases of minor criminal offenses that occur in Indonesia and are often in the public spotlight because they are legally processed using the threat of ordinary criminal penalties are considered to be very unfair because they are not comparable to the losses incurred, this is because since 1960 there has not been any renewal in the Criminal Code related to the limits of acts light criminal amounting to Rp 250, - after the issuance of PERMA number 2 of 2012 concerning Adjustment of Limits of Minor Crimes and the Amount of Fines in the Criminal Code, if previously the so-called minor felony whose value was less than Rp 250, - is now changed to Rp 2.5 million and the maximum penalty of imprisonment is 3 (three) months in prison by using a quick examination and a single judge as mentioned in articles 205-210 of the Criminal Procedure Code so that justice for perpetrators of minor crimes is fulfilled.
Problem Formulation of How is the Process of Execution of Court Decisions in Minor Crimes in the Pelalawan District Prosecutor's Office, What is the Legal Certainty Regarding the Execution of Court Decisions in Minor Criminal Cases in the Pelalawan District Prosecutor's Office. This type of research is sociological law. The population in this study amounted (--) number of people and samples (-) people. File collection methods use purposive sampling. The results of the study are the Process of Execution of Court Decisions in Minor Criminal Cases in the Pelalawan District Public Prosecutor's Office, which is not proceeding properly because of the ignorance of the Law Enforcement Officers both within the Prosecutor's Office, the Court and the Police. Legal Certainty Against Execution of Court Decisions in Minor Crimes Cases in the Pelalawan District Prosecutor's Office is inappropriate because what the Ministry of Justice and Human Rights is doing is temporarily carried out by the police with the answer that all agencies do not know the contents of the Memorandum of Understanding of the Chief Justice of the Republic of Indonesia, the Minister of Justice and Human Rights , Attorney General of the Republic of Indonesia and Head of the Republic of Indonesia's National Police.
