Penyelesaian Perselisihan Suami Istri Melalui Mediasi Pada Pengadilan Agama Dumai Kelas 1b
ABSTRACT
The household is a social institution that is not immune to conflict and dispute. When such disputes become fundamental in nature and threaten the integrity of the marital relationship, and when internal resolution proves ineffective, legal recourse through the filing of a divorce petition or claim before the Religious Court becomes the final resort. In this context, mediation emerges as an alternative dispute resolution mechanism that prioritizes deliberation and mutual agreement facilitated by a neutral third party, namely, the mediator. The mediation process at the Dumai Class 1B Religious Court is conducted in accordance with Supreme Court Regulation of the Republic of Indonesia Number 1 of 2016 concerning Mediation Procedures in Court. This study analyzes in depth the process of resolving marital disputes through mediation at the Dumai Religious Court and explores efforts to optimize the mediation process in order to sustain the success rate of mediation as a peaceful means of resolving spousal conflicts within the jurisdiction of the Religious Court. This research adopts a sociological legal research methodology, focusing on the empirical reality of the law, particularly the das sein aspect. To ensure objective and accountable results, the researcher collects primary data, which is then refined and supplemented by secondary data. The collected data is analyzed using a qualitative method, producing descriptive findings. Dumai City is deemed the most relevant location for achieving the research objectives.
The research results indicate the following First, the mediation process for resolving spousal disputes at the Dumai Religious Court proceeds smoothly, largely due to the competence of certified mediators who possess substantial experience in managing emotional dynamics and providing guidance without coercion. While no significant internal or technical obstacles were identified, challenges persist in the form of a lack of good faith from one or both parties, limited understanding of mediation as a win-win solution, and emotional pressures that hinder constructive communication. These challenges must be addressed to maximize the role of mediation in resolving marital conflicts. Second, efforts to overcome these obstacles in the mediation of marital disputes at the Dumai Religious Court are undertaken through precise identification of the root causes of conflict, along with the implementation of a mediation process that upholds the principle of voluntariness in negotiations. The objective of mediation is directed toward achieving realistic and mutually agreed settlements, ensuring the parties’ readiness to accept the consequences of their decisions, and minimizing the adverse effects of conflict. Furthermore, institutional strengthening is pursued through the utilization of evaluation instruments at both the internal and national levels.
