Framework Convention On Tobacco Control (FCTC) is International treaty that effort tobacco control for healthy world under WHO. Indonesia has not yet ratified FCTC so far the impact which will be accepted Indonesian has not ratified the treaty into national law while many state in the world that has ratifieda and observe what strategic steps that should be taken in regard by Indonesian. A problem this thesis are 1) What is the regulated on Framework Convention on Tobacco Control, 2) What is negative impact has not ratified Framework Convention On Tobacco Control for Indonesian, 3) What is positive impact has not ratified Framework Convention On Tobacco Control for Indonesian. The Method who used is normative legal research who focused on comparative law. The observe of the trait of research is descriptive. Data resources this thesis is secondary data resources. The technique for data collection used library study. Data analyzed qualitatively with conclusion method used inductively. The research approach technique this thesis is statue approach. Framework Convention on Tobacco Control is international treaty. A Indonesian had long time to regulated of tobacco control by government regulation. To date Indonesian has not ratified those international treaty with argument are 1) Economic reason, 2) labour and employment reason, and 3) Culture and history reason.
A negative impact by Framework Convention on Tobacco Control for Indonesian as acountry that has not ratified are 1) Increased illcit trade and illegal, 2) do not have regulation of the tobacco health in Indonesian, and 3) A ostracized by other countries. A positive impact by Framework Convention on Tobacco Control for Indonesia as a country thas has not ratified are 1) Development of tobacco industry in Indonesian, 2) A preservation domestic tobacco production, 3) A preservation domestic tobacco industry, 4) A preservation kretek, 5) Do not contrary to the Constitution Act 1945, 6) Do not need to pay a mandatory member of FCTC dues.
Suggest and Solustion by this problem is A Indonesian constant to not ratified the FCTC and make mature who regulate about domestic tobacco control who prosper nationally and internationally.
