" Comparison of the Use of Contraceptives Under Law No. 52 Year 2009 on Population Development and Family Development and the Islamic Law "
The population of the world , amounting to nearly 10 billion souls , proving that the population growth rate is very rapid . The swelling number of people in the world is due to a higher birth rate than death rate bayi.Program Family Planning ( KB ) is a form of action that the government's original purpose was as an effort to decrease the level of fertility in Indonesia.
Sound reproduction through birth control is a process of planning efforts have offspring ( children ) who do not compromise the safety of the mother and child with a birth spacing method ( birth control ) device or drug use . Therefore, the authors wanted to examine the use of contraceptives based Comparative Law . 52 Year 2009 on Population Development and Family Development and formulation of the problem of Islamic Law by setting how the use of contraceptives by Act No. 52 of 2009 on Population Development and Family Development , how contraceptive use settings based on Islamic law and how the similarities and differences in the use of tools contraceptives based on Law Number 52 Year 2009 on Population Development and Family Development and the Islamic Law .
Views of its kind , this study included in the category of library research (library research) or normative legal research , which aims to determine the history , objectives , benefits of contraception and how the rules contained in Law no. 52 Year 2009 on Population Development and Family Development , and according to Islamic law perspective . In this study using secondary data sources are the primary library materials , such as literature both classic and contemporary jurisprudence in four schools ( Maliki , Shafi'i , Hanbali and Hanafi ) , the Qur'an and the Hadith also previous thesis - thesis related to this research . Furthermore, the data is processed and analyzed using descriptive and comparative methods .
From the research , it is concluded that the use of contraceptive use is allowed in either of the Law . 52 Year 2009 on Population Development and Family Development and the Islamic law , only in Islamic law is not all types of contraceptives are permitted . Types of contraceptives is forbidden in Islamic law is a permanent method that makes the person can no longer have children forever through surgery .
