Penegakan Hukum Tindak Pidana Penelantaran Anak Oleh Orang Tua Di Polresta Pekanbaru
ABSTRACT
Child neglect is the act of failing to meet the basic needs of a child, including physical, emotional, educational, and medical care, which should be fulfilled by the parents or responsible parties. This act severely impacts the growth and development of children and violates their fundamental rights as protected under Law Number 35 of 2014 concerning Child Protection. Law enforcement against child neglect crimes is crucial to provide protection and recovery for the victims, as well as to prevent the recurrence of such violations.
This study aims to analyze the law enforcement process against child neglect crimes committed by parents at Polresta Pekanbaru, including the obstacles faced by law enforcement officers and the efforts undertaken to address these challenges. The research method employed is socio-legal, combining interviews, observations, and document studies. The study presents a comprehensive overview of the legal mechanisms, investigative procedures, and the role of supporting institutions in child protection.
The research findings indicate that Polresta Pekanbaru has implemented law enforcement procedures in accordance with applicable regulations, starting from receiving reports, verification, examination of victims and witnesses, to investigation and suspect designation. The involvement of psychologists and related agencies is an integral part of the process to protect the rights of child victims through the judicial process. Key challenges include limited evidence, economic conditions of offenders, and varied levels of community awareness. Mediation is often chosen as an alternative dispute resolution to prioritize the best interests of the child.
This study recommends enhancing legal education for the community and strengthening the capacity of law enforcement officers to overcome these obstacles and optimize child protection comprehensively. Collaboration between law enforcement, communities, and child protection agencies is essential to ensure that law enforcement functions not only repressively but also preventively and rehabilitatively.
