Tinjauan Partisipasi Masyarakat Dalam Bentuk Petisionline Pada Pembentukan Undang-Undang
ABSTRACT
The development of information technology has driven changes in the
patterns of public participation in the legislative process in Indonesia. One form of
participation that has emerged is online petitions, which serve as a means for
citizens to collectively and openly voice their aspirations. The research question in
this study is how strong the legal force of online petitions is in the law-making
process in Indonesia, and to what extent this mechanism is accommodated in the
national legal system.
This study employs a normative legal approach with qualitative analysis
methods. The data sources used consist of primary and secondary legal materials
that are systematically analyzed. The study is also supported by case studies of
several online petitions that have had a significant impact on the legislative
process in Indonesia, with the aim of assessing the extent to which this form of
digital participation is effective and legally valid within the existing legal
framework.
The results of the study indicate that online petitions do not yet have
binding legal legitimacy within the national legal system. However, online
petitions have proven to function as a non-formal means of public participation
with strong political and sociological influence. The mechanisms for public
participation in legislation are currently conventional and have not accommodated
the development of digital participation. Therefore, regulatory updates are needed
to provide legal certainty for online petitions as part of e-democracy in the
formation of laws in Indonesia.
