ABSTRACT
In recent times, the utilization of residential streets as parking spaces has become increasingly prevalent within the community. This practice has resulted in various negative impacts affecting the daily lives of residents. Streets intended for shared use are instead utilized for the personal convenience of specific individuals, causing discomfort among local residents. This issue is exacerbated when such practices persist over an extended period. This study aims to examine, and analyze the use of streets as parking spaces for private vehicles in residential areas, as well as the form of legal responsibility of vehicle owners who park their vehicles on residential streets.
The type of research to be employed in this study is sociological legal research. This research will be conducted at Villa Selecta Mas Residential Complex, located on Jalan Buah Tampui, Tambang Sub-District, Kampar Regency. Data collection will be carried out using both primary and secondary data sources. The data gathering activities in this research will involve observation, interviews, and literature studies. The data analysis applied in this study is qualitative analysis based on the existing facts to obtain answers to the research problems, and the data will then be presented descriptively.
The results of the study indicate that: (1) The practice of using residential streets as parking spaces for private vehicles occurs due to limited parking areas, weak enforcement, and low public legal awareness.. This practice has led to several negative impacts, including obstructed road access, increased risk of accidents, and social conflicts among residents. However, in practice, conflict resolution tends to prioritize social approaches such as deliberation and verbal warnings rather than formal legal mechanisms. This highlights the need for stricter enforcement of regulations, improvement of parking facilities, and continuous legal education within the community. (2) The legal responsibility of private vehicle owners who park on residential streets is essentially regulated under civil law through the mechanism of unlawful acts (tort). However, in social practice, this legal responsibility is often carried out merely in the form of informal social responsibilities, such as relocating the vehicle or offering apologies. The lack of strict sanctions and the low level of legal awareness among residents are the primary factors contributing to the suboptimal enforcement of legal responsibilities within the residential area.
