Peran Lembaga Adat Dalam Penanggulangan Kebakaran Hutan Diwilayah Ulayat Masyarakat Hukum Adat Kabupaten Pelalawan
ABSTRACT
Forest and land fires frequently occur in Pelalawan Regency, an area characterized by extensive land use for agriculture, plantations, and industrial forest plantations. This condition renders the region particularly vulnerable to forest and land fires, especially during the dry season, with such disasters recurring annually. The forest fire incident on customary (ulayat) land in Sotol Village, Pelalawan Regency, was primarily caused by local residents engaging in land clearing through burning, as well as by fishermen discarding cigarette butts carelessly and failing to extinguish fires after grilling fish.
This study employs a sociological legal research method. The approach adopted by the researcher is empirical, focusing on how law operates within society. The research was conducted in Sotol Village, Langgam Sub-district, Pelalawan Regency. The population and sample in this study consist of the Customary Chief, Traditional Leaders, and the Village Head. This research utilizes secondary data, and data collection techniques were carried out through interviews.
This study concludes two main findings. First, the role of customary institutions in addressing forest fires within customary law territories is highly significant. These institutions serve to protect and preserve the environment of the customary village. The sanctions imposed function as a preventive measure—intended to deter future violations of customary law. Although forest fire incidents are still frequently encountered, resolutions through customary mechanisms have become increasingly rare. However, when such cases do occur, customary sanctions are still applied and enforced to prevent such actions from becoming habitual and passed down to future generations.
