ABSTRACT
Consumer protection is all efforts that ensure legal certainty to provide protection to consumers. The issue of the circulation of processed food produced by household industries without a Household Industry Food Permit (PIRT) is a significant issue in the context of consumer protection. The PIRT permit is a form of legality and guarantee that a processed food product has met quality and food safety standards. In Tambang District, Kampar Regency, there are still business actors who distribute processed food without fulfilling the requirements related to the PIRT permit. This condition causes consumer losses and reflects the non-performance of the obligations of business actors as stipulated in Law Number 8 Year 1999 concerning Consumer Protection.
This study analyses the liability of business actors related to food without a PIRT permit, particularly for losses suffered by consumers due to consumption of food products that do not meet safety standards. This study assesses the compliance of business actors with legal obligations that should be fulfilled in order to ensure the protection of consumer rights, especially the right to comfort, security and safety in consuming food products. In addition, this study examines the efforts made by consumers to claim their rights related to food products without a PIRT permit that do not meet food quality and safety standards as regulated in legislation. The method used in this research is the sociological approach method, with data collection techniques through interviews and distributing questionnaires to respondents.
The results showed that business actors distributing processed food products from home industries without a PIRT permit have violated their obligations and causing losses to consumers. Furthermore, business actors liability for losses incurred by consumers has not been properly implemented. The non-fulfilment of these obligations directly impacts consumers. Consumers suffer losses due to consumption of unlicensed food and consumers who are harmed by a product are entitled to make efforts for their rights. However, there are still consumers who do not make any efforts to obtain the rights they should have. Therefore, consumer awareness of their rights must be increased. In addition, business actors in carrying out their business must fulfil their liability and pay more attention to the rights of consumers.
