Problems of land in our country is a problem that is quite complicated and sensitive, as it relates to various aspects of life, whether they are socio-economic, cultural, political law and the defense passage, so to overcome it may not only be done through an approach unilaterally, but rather must go through an integrated approach in order to obtain a settlement completely. Land has a very important position in customary law, because it is the only thing that despite the wealth of any set of circumstances will remain in a state semula.banyak communal land located in the village of mortar base is already no longer managed and used indigenous napuh old mind has been diverted into private ownership by the indigenous people of Batin Tua Napuh.
This type of research can be classified in this type of research socio-juridical, because in this study the authors directly conduct research at research sites in order to give a complete picture and clear about the issues examined, the study was conducted on one pebatinan indigenous peoples Petalangan the indigenous peoples of Batin Tua Napuh in the district Pelalawan, while the sample population is a whole party with regard to the issues examined in this study, the data source used, primary data, secondary data, and the data tertiary data collection techniques in this study by observation, interview and literature study ,
From the research issue there are three main things that can be inferred. First, over the times function, utilization and preservation of communal land forest decline, it is caused by a process of fairly rapid development period and the lack of understanding and awareness of indigenous peoples' communal land forest functions. Second, by legislation transition / sale and purchase of the communal land can not be done, the buying and selling of communal land would be detrimental to the child's nephew as the successor of indigenous peoples, and the sale and purchase of the communal land will have a negative impact in the future that will happen dispute communal land , Third, the procedure for the transition of communal land based on customary laws on indigenous peoples' Batin Tua Napuh, because customary law is the law which is largely unwritten, then regulation on the procedure transition customary lands of indigenous peoples Batin Tua Napuh not like the rules that should be done by law the prevailing custom, author's suggestion, first, indigenous people should be able to restore function, utilization and conservation of forest communal land as before, a second, shift the sale of communal land to the indigenous peoples' Batin Tua Napuh must be in accordance with applicable regulations, third, Assembly agencies Malay adat Petalangan (LAP) shall perform its functions optimally. So it will not happen again switchover purchase communal land of the indigenous peoples Batin Tua Napuh.
