Minangkabau society is a society that adopts an interesting kinship maternal lineage (matrilineal). In Minangkabau society there is a legacy that is a wealth gained from previous ancestors who inherited from mamak (uncle) to the nephews. The process of transfer of power in a custom called the pusako basalin. Inheritance is collective, which is inherited by a group of heirs that should not be divided ownership, but mastery shareable called ganggam bauntuak. In principle, these treasures should not be in perjualbelikan or mortgaged except with four reasons. However, because of the times and the demands of the economy allowed to sell heirloom high due to certain conditions. The purpose of this thesis namely; First, to determine the shape deviation from the rules of customary law in the transition treasures in Nagari Pasia Agam District of Ampek Angkek; Second, to find out people's views against the practice of buying and selling high inheritance in Nagari Pasia Agam District of Ampek Angkek; Third, to determine the role of KAN (density Adat) in resolving disputes and inheritance transition Pasia village high in the District Ampek Angkek Agam.
This type of research is a kind of empirical juridical, can be a study of the identification law (unwritten), where it is carried out to determine the unwritten law by the applicable law in the society, as well as research on the effectiveness of law that addresses how the law operates in community. This research requires the researcher to know the science of law, social sciences and memeiliki knowledge in social science research.
From the research, there are three main things that can be inferred. First, deviations from the rules of customary law in the transition inheritance happens is selling high inheritance by dividing the treasure secretly to the beneficiary, and part of each certified. Secondly, concerning the sale and purchase of high inheritance in Nagari Pasia different perspective, which does not allow the sale and purchase more priority so that the common law in order to remain sustainable and no compromises in it. Which allows buying and selling that customary law that adopts a dynamic consensus can be compromised. Thirdly, measures shall be preceded by the completion of consultations at the level of family, clan, and pesukuan. KAN can act as a mediator in resolving disputes if these three steps have been in the family traveled to the dispute.
