Penerapan Sanksi Terhadap Pelaku Tindak Pidana Pencurian Ringan Tandan Buah Segar Kelapa Sawit Di Rokan Iv Koto
ABSTRACT
The theft of fresh fruit bunches of oil palm is a crime that often occurs and causes economic loss and insecurity in the community. Law enforcement against this petty theft faces various obstacles, such as the value of losses often being below the minimum limit for formal criminal handling, leading to many cases being resolved through restorative justice, customary sanctions, and social sanctions. Therefore, the objectives of this thesis research are: first, the implementation of sanctions against perpetrators of petty theft of fresh fruit bunches of oil palm in Rokan IV Koto, the obstacles faced in implementing sanctions against perpetrators of petty theft of fresh fruit bunches of oil palm in Rokan IV Koto, and the efforts made to address the obstacles in implementing sanctions against perpetrators of petty theft of fresh fruit bunches of oil palm in Rokan IV Koto.
This research is a sociological study, which means it approaches the issues being researched with the characteristics of real law or in accordance with the realities of life in society. This research was conducted in the jurisdiction of the Rokan IV Koto Police Sector, and also at the Lubuk Bendahara village office. The population and samples are the parties involved in the issues being studied in this research. The sources of data used are primary data, secondary data, and tertiary data. The data collection techniques in this research were through observation, interviews, and literature review.
The results of this study can be concluded as follows: First, the main factors driving individuals to commit theft are difficult economic conditions, low levels of education, limited job opportunities, and obstacles in the enforcement of formal law. The implementation of customary and social sanctions becomes a faster and more efficient alternative, but it has less deterrent effect and lacks formal legal power. Other obstacles include weak coordination among agencies, changes in cultural values, and a lack of legal awareness in the community, which also affect the effectiveness of sanction implementation. Efforts made include strengthening coordination among law enforcement officials, revitalizing the role of customary institutions, legal socialization, and empowering the community economically. This study concludes that the implementation of effective sanctions requires an integrative approach between formal law, customary law, and social norms based on local wisdom, as well as synergy among stakeholders to create a safe, fair, and just environment in Rokan IV Koto.
