Penyelesaian Wanprestasi Pada Kontrak Antara Wedding Organizer (Wo) Dengan Klient Di Kabupaten Kampar

ABSTRACT
An agreement that occurs between the client and the wedding organizer
when agreeing to use the services of a wedding organizer to arrange and plan the
wedding is called an engagement. In order for the alliance that occurs between
the client and the wedding organizer to have legal certainty, a written agreement
is made so that the obligations between the client and the wedding organizer are
more detailed and clearer to avoid misunderstandings. The agreement made after
the agreement between the client and the wedding organizer aims to clarify the
achievements or obligations of the client and the wedding organizer. In order for
the agreement to be clear, the agreement is made in written form, but in its
implementation, the agreement does not always run smoothly. If an agreement
does not run smoothly and is not in accordance with the agreement, then it is
called a breach of contract. This research aims to find out how the
implementation of the client's agreement contract with the wedding organizer
used by his services. In addition, due to the breach of contract that occurs
between the client and the wedding organizer, this study aims to find a solution to
solve the breach of contract that occurs.
The method used in this study is a sociological research method. This
research was conducted in Kampar Regency, Bangkinang Kota District, Riau
Province. Then the population and sample include decorations or Dycha NS
Wedding Organizers, Clients and related vendors. The data sources used are
primary data, secondary data, and tertiary data. The data collection techniques in
this study are interviews and literature reviews.
The implementation of the agreement between the client and the wedding
organizer aims to ensure legal certainty between the client and the wedding
organizer. In the written certificate there are achievements that must be done by
the client and the wedding organizer. In addition to mandatory achievements in
the agreement, there are also provisions such as force majeure, legal settlement
and data from the parties concerned. The breach of contract that occurred was
also discussed in the legal settlement section. Settlement of breach of contract can
use litigation and non-litigation channels. The Non-Litigation Path is classified as
economical, fast, short and private, this is a consideration when choosing the
breach of contract settlement path. Mediation and Negotiation can be carried out
by the client and the wedding organizer in resolving the problem of default that
occurs. Based on the case that occurred, the solution that can be provided is to
write in detail the vendors involved and write a detailed legal settlement path in
the contract.
