Tinjauan Terhadap Penerapan Surcharge Oleh Pelaku Usaha Kepada Konsumen Dalam Transaksi Menggunakan Kartu Kredit
The use of credit cards in the present is often carried out by modern society as a means or means of payment and various transactions for consumption needs. The credit card implementation basically covers the relationship between the credit card holder or the cardholder, the credit card recipient seller or the merchant and the bank as the credit card issuer or card issuer. The implementation of credit card is inseparable from the legal relationship that occurs behind it all, the legal relationship between the credit card company and the credit card holder or the merchant, as well as the legal relationship between the credit card holder and the merchant where the credit card holder is shopping. Additional fees (surcharge) are fees charged by merchants to consumers when transactions use a credit card. In the regulations there is no regulation clearly related to surcharge even in the explanation.
This type of research can be classified in the type of sociological legal research (empirical), because in this study the authors immediately conduct research on the location or place under study in order to provide a complete and clear picture of the problem under study. This research was conducted in Pekanbaru City, while the population and samples were Cards and Merchant Business Managers, Assistant Sales Cards and Merchant Business, Merchant Branch Relationship, Merchants, and Consumers. The data sources used are primary data, and secondary data. Data collection techniques in this study were interviews, questionnaires, and literature review.
The conclusion that can be obtained from the results of the study is the application of surcharge by business actors to consumers is very detrimental and does not provide a sense of justice for consumers. business actors who still make additional costs to consumers without considering consumer objections in each transaction. Some business people also know that the use of surcharge is prohibited but the business actor continues to carry out surcharge. Though the actions taken give a loss to consumers in each transaction. Protection of consumers in the application of surcharge by business actors in transactions using credit cards still does not fully obtain legal protection, moreover consumers do not complain about imposition of surcharge. The imposition of surcharge on credit card transactions carried out by card holders can be considered as an adverse action. Constraints on the application of surcharge by business players to consumers with transactions using credit cards in providing justice for consumers consist of constraints on the part of the Bank, constraints of business actors and constraints of the consumer.Keywords: Application, Surcharge, Merchant, Consumers, Transactions, Credit Cards
