Penegakan Hukum Tindak Pidana Kekerasan Seksual Terhadap Anak Di Daerah Kepolisian Resor Siak
ABSTRACT
The phenomenon of sexual violence against children in Siak Regency still
occurs at a fairly high rate, even though this area has received the title of Child-
Friendly Regency from the Ministry of Women's Empowerment and Child
Protection of the Republic of Indonesia. This condition shows a gap between the
symbolic awards received and the reality on the ground, so an in-depth study is
needed regarding the effectiveness of law enforcement in the area. The problems
raised in this study include how the law enforcement process is carried out, what
factors are obstacles, and what efforts can be made to overcome these obstacles.
This type of research is empirical legal research or sociological research.
The research location is at the Siak Police Resort, and the Technical Service Unit
for the Protection of Women and Children of Siak Regency. While the population
and sample are all parties related to the problem being studied. The population
and sample in this study are the Head of Unit IV of the Siak Police Criminal
Investigation Unit, the Banit Idik IV of the Siak Police Criminal Investigation
Unit, the Head of the Siak Regency PPA UPT, and the Head of the Riau Malay
Customary Institution of Siak Regency. This study uses primary and secondary
data sources, and data collection techniques are carried out by interview and
literature study.
Based on the results of the study, it was found that law enforcement against
sexual violence against children at the Siak Police has referred to Law No. 35 of
2014 concerning Child Protection and Law No. 12 of 2022 concerning TPKS.
However, its implementation faces various obstacles, such as limited human
resources, a community culture that is taboo about discussing sexual violence,
minimal courage for victims to report, and a lack of supporting facilities. Socioeconomic
and information technology factors also worsen the situation. Aspects
that need to be improved to increase the effectiveness of law enforcement against
criminal acts of sexual violence against children with the active role of law
enforcement officers and related agencies and increasing the effectiveness of nonphysical
evidence in criminal acts of sexual violence against children.
