ABSTRACT
Child neglect is one of the problems that requires special attention in its
resolution because it does not only involve the role of parents and children but
also efforts from the government, related institutions and the surrounding
community. Siak Regency has a number of cases of child neglect that generally
increases every year, but experiences obstacles in resolving its cases, these
obstacles do not only consist of obstacles from the authorities in resolving the
case but also obstacles from the community itself so that it causes legal problems
in resolving the case. Therefore, this study was conducted to find out the problems
that occur and what efforts can be made to resolve the problem of child neglect in
Siak Regency. This is realized to reduce cases of child neglect so that children get
their rights in order to create child protection as stated in Law No. 35 of 2014
Amendment to Law No. 23 of 2002 concerning Child Protection.
This type of research is sociological or empirical legal research, namely
research obtained directly from the community or primary data research. This
study aims to obtain a correlation between legal regulations and their
implementation in the community by agencies.
Based on the results of the study, the Legal Problems of Resolving Child
Neglect Crime Cases in Siak Regency occurred due to two factors, namely, factors
from the community itself which have not played a role and do not have legal
awareness regarding law enforcement and protection of children in dealing with
cases of child neglect that occur. Then the factor from the government is the lack
of coordination and minimal budget funds in resolving cases of child neglect in
Siak Regency. Thus, the resolution of the case is still not as expected and still
requires more efforts and roles from the community and the government and
related agencies.
