Akibat Hukum Force Majeure Pada Perjanjian Kredit Badan Usaha Milik Desa (Bumdes) Tunas Harapan Jaya Desa Puo Raya

With Presidential Decree Number 12 of 2020 concerning the Determination of Non-Natural Disasters from the Spread of Covid-19 as National Disasters. Force majeure cannot be the main reason for canceling a credit agreement, but can be used as a reason for negotiating to change or cancel the contents of the agreement. This research was conducted to find out what are the force majeure factors in the Tunas Harapan Jaya Village-Owned Enterprise (BUMDes) Puo Raya Village and what are the legal consequences of force majeure on the credit agreement of the Tunas Harapan Jaya Village-Owned Enterprise (BUMDes), Puo Raya Village.
This research is empirical juridical research. The data used in this research are primary data and secondary data. Primary data was obtained from field research using interview guidelines. Meanwhile, secondary data was obtained through literature review. The data analysis technique used was qualitative descriptive analysis.
The results of this research are the factors that prevent customers from paying credit installments at BUMDes Tunasa Harapan Jaya in general due to the impact of Covid-19 and specifically there are several factors such as experiencing bankruptcy, reduced income, being laid off from the company, illness. annual (severe), and crop failure, and there are also customers who have bad character (not in good faith) even though they are able to carry out their achievements. Furthermore, the failure to carry out customer achievements due to the Covid-19 pandemic, which prevents customers from carrying out achievements is categorized as force majeure, which creates a risk that must be borne by customers and BUMDes together. The impact of force majeure on the BUMDes Tunas Harapan Jaya credit agreement has not experienced any changes in its implementation, only there has been a delay in implementation. The credit settlement efforts provided by BUMDes Tunas Harapan Jaya refer to the Financial Services Authority Regulation (Pojk) Number 48/POJK.03/2020 by means of rescheduling, namely by giving debtors the opportunity to pay off their credit by extending the credit period and installment period.
