Analisis Yuridis Terhadap Tindak Pidana Jual Beli Chip Game Online Dalam Hukum Pidana Indonesia
ABSTRACT
The development of digital technology has affected various aspects of life, including entertainment through applications. One example is the online game Higgs Domino Island, which allows players to use and purchase chips to participate in various types of games. The practice of buying and selling these chips has raised legal concerns, particularly when they hold economic value and are traded freely outside of official platforms.
This research focuses on two main issues, how the elements of criminal acts in the sale of online game chips fulfill the criteria of gambling under Indonesian criminal law, and how judges interpret such cases differently in court. This study applies a normative juridical method with a statutory and case approach, using analysis of three relevant court decisions.
The results of this study indicate that the practice of buying and selling online game chips fulfills the elements of a criminal act of gambling, particularly the element of “providing an opportunity to gamble” as stipulated in Article 303 paragraph (1) of the Indonesian Criminal Code (KUHP). However, in its application, differences in interpretation among judges when ruling on similar cases were found, indicating a lack of uniformity in the enforcement of the law. Therefore, more consistent law enforcement and clearer regulations are needed to prevent multiple interpretations in the application of criminal provisions.
