Penggunaan Cluster Bombs Dalam Perang Rusia-Ukraina Oleh Militer Rusia Ditinjau Dari Hukum Humaniter Internasional
ABSTRACT
Along with the development of science and technology, techniques and tools
of warfare have also developed. Humans have created weapons of war that are
highly effective in crippling opponents. As technology has developed, so has the
inhuman and destructive nature of these weapons, one of these being the cluster
bomb. Many countries oppose the use of cluster bombs since they have a negative
impact on the safety of civil society, one of which is Russia, which its military
used Cluster Bombs against Ukraine, both in times of war and post-war.
Therefore, the international community has decreed that cluster bombs are
banned components of warfare. These weapons have been studied and analyzed in
relation to 1.) What is the legal regulation regarding the prohibition on the use of
Cluster Bombs according to International Humanitarian Law? and 2.) How is law
enforcement against violations of International Humanitarian Law in the form of
the use of Cluster Bombs by the Russian military in the Russian Ukrainian armed
conflict? This study uses a normative juridicial approach. The research data in
this paper is secondary data. Data collection techniques and data analysis have
used qualitative approaches. It can be concluded that the banning of cluster
bombs is internationally regulated under several international treaties and laws,
namely:the Convention Hague IV 1907, concerning the laws and customs of war
on land; the Additional Protocol I of 1977 Geneva Conventions, on the protection
of the civilians; the Convention on the prohibition of the use of conventional
weapons particular (Convention on Certain Coventional Weapon) in 1980; and
the Convention on Cluster Munition. Efforts in the enforcement of these
international humanitarian laws against the use of cluster bombs include
prevention, repressive efforts, and rehabilitative efforts for those who are
negatively impacted by this weapon of destruction.
