ABSTRACT
This research shows that the implementation of OSB policies during the reign of PM Abbott can indeed be said to have succeeded in reducing the arrival of boatmen. But on the other hand, the implementation of the policy has the potential to violate human rights through non-adherence to the principle of non-refoulement. In reality, asylum-seeking boats that came to Australia during PM Abbott's reign have been blocked and returned to their home territories. Their return to the territory of origin is a violation of the principle of non-refoulement that has been recognized as customary international law. Australia is a popular destination country for refugees and asylum seekers compared to countries in Europe, as the European region has adopted stricter refugee policies. This research uses securitization theory with a level of state analysis. Securitization is a theory developed by thinkers from the Copenhagen School including Barry Buzan, Ole Weaver and Jaap de Wilde. According to the Copenhagen School, the Securitization Process has two stages, including the stage of raising issues and the stage of convincing the audience. At the stage of emergence of issues state or non-state actors for example trade unions or people's movements describe certain issues, people, groups, or entities as existential threats to the target object or community. The second, more important stage concerns the success of securitization which depends on whether or not the audience is convinced to accept that a particular reference object is indeed existentially threatened. In this concept, the Copenhagen School also places more emphasis on the role of the audience to recognize the threat and thus support a speech act.
