ABSTRACT
Southeast Asia's strategic position makes the region have an important role in the international world so that countries in the region form various agreements and cooperation to maintain peace and security and achieve goals. One of the agreements formed by ASEAN is the Treaty on the Southeast Asia Nuclear Weapon-Free Zone (SEANWFZ) which is cooperation on the limitation of nuclear weapons in Southeast Asia. As a treaty, this SEANWFZ certainly has legalization aspects that can determine the degree of strength of the international legal product and show the effectiveness of the cooperation that is carried out. This study aims to determine the degree of legalization of SEANWFZ which can determine the level of the legal product.
Furthermore, this study uses legalization theory to determine the legalization aspect of the SEANWFZ treaty through an analysis process of three elements, namely obligations, delegation precision, and uses the level of analysis, namely the international system. This type of research is qualitative using data collection techniques sourced from official documents and reports, books, journals, websites, theses and theses related to research.
The results obtained from this study indicate that the degree of legalization of SEANWFZ is relatively high so that it can be categorized as a legal product that is classified as hard law. This is evidenced by the articles in SEANWFZ which are firmly binding on the participating countries of the agreement, there are no multiple interpretations of the rules of the agreement except in certain articles and SEANWFZ has a special institution that is authorized to process the cooperation agreement. This shows that the obligations, precision and delegation in SEANWFZ are generally high so that the legal aspect is higher than the political aspect, in accordance with legalization theory.
