Abstract
The problems of Indonesian Migrant Workers (TKI) abroad have never been solved by the Indonesian government, starting from not being paid their salaries, to hundreds of TKI who have been persecuted and threatened with the death penalty abroad, especially in Vietnam. The main cause of cases of abuse of migrant workers working in Malaysia, due to differences in labor laws, miscommunication between employers and migrant workers is the cause of employer anger, the low competence of migrant workers and the high demands of employers are the cause of employer dissatisfaction with the results of the work of migrant workers which results in anger and torture and cultural differences between migrant workers and employers.
The Indonesian government is still judged by not being proactive and comprehensive in providing protection, both physically and financially, especially from a legal perspective, for troubled migrant workers. The emergence of various problems regarding the protection and placement of these migrant workers and based on various considerations, one of the contents of which emphasizes that recruitment of workers is still carried out by the private sector and is mandatory through BNP2TKI, which is responsible for their placement. Thus, one of the axes of the problem of expulsion of migrant workers has been accommodated. It was also agreed to form Joint Task Forces (JTF) to oversee and monitor the implementation of the MoU. The authority to manage TKI is given to BNP2TKI so that the policy on the placement and return of TKI is carried out in one door so that the problems of TKI can be reduced.
With the existence of a policy on TKI, it is hoped that it will be able to overcome, provide solutions, and solve problems for TKI that have been shackled by Indonesian society in general, and the Government of Indonesia and TKI in particular. A positive legal view of the government's efforts to protect Indonesian Migrant Workers through cooperation in making laws and sending Indonesian-Vietnamese Migrant Workers Professionally and in accordance with existing procedures. What has been done by the Indonesian government in protecting the rights of its citizens working abroad. However, cooperation between countries, institutions and society is needed, especially to create comfort and security for Indonesian migrant workers working abroad.
