Tinjauan Yuridis Penguatan Partisipasi Masyarakat Dalam Pembentukan Peraturan Desa Berdasarkan Pasal 24 Undang-Undang Nomor 6 Tahun 2014 Tentang Desa
Village Regulations are the legal framework for policy in the administration of governance and development within the village, but so far the process of their formation has not been optimal in accordance with the laws and regulations. One tangible form of the non-optimal formation of Village Regulations by involving the community is that the Village Regulations that are designed and will be made have no process of collecting community aspirations. In addition, information disclosure regarding Village Regulations that have been made is still difficult to access. These problems lead to Village Regulations still experiencing inequality. Therefore, it is necessary to study how regulations related to community participation in the formation of Village Regulations are associated with the principles of participation and transparency.
The type of research used by the author is normative legal research. Normative legal research is conducted by examining library materials or secondary data. The data collection technique in this research is library research. This technique can be used to limit the use of document studies or library materials only, namely secondary data. In writing this thesis, the author uses qualitative data analysis which produces descriptive data. With qualitative analysis, a researcher aims to understand or understand the symptoms he is researching.
The results of this thesis research state that the regulation of community participation in the formation of Village Regulations based on Article 24 of Law Number 6 of 2014 Concerning Villages is very good because of the regulation of each legal derivative, but in practice it still fails due to community participation being considered as a mere formality. Then the ideal form of community participation in the formation of Village Regulations in accordance with Article 24 of Law Number 6 of 2014 concerning Villages is not only based on technical requirements, but must also be in accordance with juridical, sociological and philosophical principles.
