Regional Head Elections Before and After the Amendment to the 1945 Constitution, where regional head elections varied from the New Order era to the current reform period. In administering government, Indonesia is known as a unitary state which is managed based on democratic understanding where the region concerned is led by a regional head, both in provinces and districts/cities. For provinces, the regional head is called Governor and for districts the regional head is called Regent and for cities the head regions are called Mayors. The 1945 Constitution is the basis for administering national government, including regional government. Elections are a real manifestation of democracy and are a means for the people to declare their sovereignty over the State and the Government. People's sovereignty can be realized in an election process based on Pancasila and The 1945 Constitution of the Republic of Indonesia was implemented on the principles of direct, general, free, confidential, honest and fair within the Unitary State of the Republic of Indonesia (NKRI).
This research aims to find out how regional head elections before and after the amendments to the 1945 Constitution were seen from a democratic perspective and ideal regional head elections in the future.
The method used in this normative legal research in conducting data analysis is to carry out analysis with qualitative measures that rely on substance with data collection that draws conclusions.
As a result of this research, it can be concluded that the legal politics of regional head elections before and after the amendment to the 1945 Constitution continues to undergo a system restructuring process from initially being undemocratic towards a more democratic direction in accordance with the political configuration behind it.
