Politik Hukum Pemindahan Ibukota Negara Republik Indonesia Dalam Perspektif Pertahanan Negara
The relocation of the national capital from Jakarta to Kalimantan has been taken as a strategic decision that considers various important dimensions including political, economic, social, cultural and national defense. Although various factors were considered, national defense should be the main focus in this move. State security and sovereignty are fundamental priorities that form the basis of transition planning.
This research is a normative juridical legal research that aims to explain the legal politics and success of the transfer of the State Capital of the Republic of Indonesia from Java to Kalimantan in maintaining state sovereignty. The data used in this research are sourced from literature in the form of print and electronic media.
The results showed that the relocation of the National Capital of the Republic of Indonesia is a strategic step that relies on a strong legal basis, consensus between government institutions, and participation of people's representative institutions in response to the development of increasingly complex threats, including non-military threats involving various aspects. In this effort, integration with the concept of sishankamrata, involving intelligence, defense, security, and cyber components, and supported by the principles of constitutionalism, checks and balances, and participation across state institutions are important to maintain harmony in the Indonesian constitutional system. While the relocation of the capital city is an ambitious move with significant impacts on defense, the economy, and the constitution, the government's steps taken to date reflect a determination to ensure success and constitutional sovereignty in this process. The success of the new capital city in maintaining the country's sovereignty relies heavily on careful implementation, good inter-agency coordination and transparency in the use of public resources, with the need for further evaluation as the move moves closer to full implementation, particularly in maintaining a balance between defense, economic and constitutional aspects.
