Since the beginning, the Constitution of the Republic of Indonesia has regulated human rights and the rights of citizens in the form of guarantees for the independence of each resident to embrace religion and to worship according to his religion and belief. Freedom of religion and worship which is the freedom to embrace one's religion of belief or change from one's religion as well as freedom to worship according to one's religion of belief which of course must be carried out freely without any intervention or coercion from other parties who wish to interfere or prohibit and limit these freedoms which in practice such freedom must remain within the limits as regulated in the legislation. So that it can be said that the guarantee of the right to freedom of religion and worship is important so that the life of the nation and state runs in harmony.
This type of research can be classified into normative legal research. Normative legal research is studying various laws and regulations, journals, and related legal theories.
From the research results, it can be concluded that the Constitution of the Republic of Indonesia provides regulations, guarantees and requires the protection and enforcement of the rights and freedoms of religion and worship. Guarantees that are clearly stated in Article 28E paragraph (1) and Article 29 which basically state that everyone is free to embrace religion and worship according to his religion and the State guarantees the independence of each resident to embrace their own religion and to worship according to their religion and belief. that. In fact, there are still frequent cases of violations of freedom of religion and worship which in this case can be said to have not fully implemented the guarantee of freedom of religion and worship as guaranteed by the State. There is a need for a Legislation that regulates the guarantee of the right to freedom of religion and worship which is the mandate of the 1945 Constitution. The regulation of the guarantee of the right to freedom of religion and worship is very important, especially since Indonesia is a country that recognizes several religions to live and develop. within the Republic of Indonesia. The number of religions professed by the community causes understanding and regulation of this matter to be a must, so that the potential for conflict in society can be minimized.
